For what purpose do we process your data?

We process your data in the context of the recruitment process (search and selection of staff) to fill vacancies at Solutions GmbH.
You can apply for a specific position or send us an unsolicited application. A recruiter from BEKO Solutions GmbH will then contact you by email or telephone to inform you of the next steps in the recruitment process.
The recruitment process is supported by our recruitment software.
If you accept a separate voluntary declaration of consent in addition to this data protection information, we will keep your data after the recruitment process has been completed. This enables us to inform you by email or telephone about future vacancies and to offer you the opportunity to re-apply to us at a later date using your candidate profile.

On what legal basis do we process your personal data?

We process your personal data on the basis of your consent. We cannot and will not process your personal data without your consent.
Processing is also carried out for the purposes of compliance with legal obligations and legitimate interests relating to the establishment, exercise or defence of legal claims (e.g. claims under the Equal Treatment Act).
You are under no legal or contractual obligation to disclose your personal data. However, without your personal data, we cannot process your application or inform you of future vacancies.

What personal data do we collect and process?

When creating a candidate profile, the following categories of data are collected and then processed:
Personal data (e.g. first and last name)
Address and contact details (e.g. address, telephone number, email address)
Application documents (e.g. CV, cover letter or certificates)
Information about your professional experience (e.g. details of your previous jobs).
Information about your educational qualifications (e.g. details of school or university diplomas).
job requirements (e.g. job profile, job description, desired scope of employment, notice period, expected salary)
Other skills and qualifications (e.g. additional training, certificates, languages or hobbies)

During the further recruitment process, your data will be completed by the recruiter of BEKO Solutions GmbH:
interview dates, interview notes and comments on your profile.
Correspondence between the applicant and employees of BEKO Solutions GmbH
Keywords and additional job profiles to help you find your profile in the candidate database.
Additional positions we suggest (if you accept a separate voluntary declaration of consent)

Please note that medical data, information on racial or ethnic origin, political, religious, trade union or sexual orientation are among the most sensitive data. We therefore ask that you do not provide us with this information.

We would like to draw your attention to the fact that some of our clients regularly request Covid-19 vaccination status and/or insist on Covid-19 vaccination as a prerequisite for an on-site assignment. BEKO Solutions GmbH does not make any recommendations in this respect. It is up to the applicant to decide whether they wish to provide information on vaccination status.

Correctness of your data

We can only process your application properly if the information you provide is correct. By giving your consent, you confirm that the information you have provided is complete and that all the information it contains is true.

Who has access to your data?

Employees of BEKO Solutions GmbH:
Access to the personal data collected and processed (see above) is granted to responsible employees of BEKO Solutions GmbH in order to fulfil the purpose.
Access is strictly regulated and is normally only granted to persons employed by BEKO Solutions GmbH and to managers and key employees in the relevant departments. Our employees are obliged to maintain confidentiality and secrecy.
If you apply as part of a labour leasing process, it is regularly necessary to provide your personal data in the form of a qualification profile to our client as a potential employer in the context of the labour leasing relationship that is about to commence. This transfer is made in accordance with the applicable data protection regulations. Your data will be processed and made available to our client. If you are then included in the selection process for the position, we will pass on our client’s data to you.

Technical service providers:
We use service providers (known as processors) to support the management of the recruitment process.Examples of such service providers are the manufacturer/tenant of our recruitment software or hosting providers who provide us with servers to run the software. These service providers have access to your data on a case-by-case basis for maintenance purposes. They are contractually bound by the contract processing agreement to confidentiality and appropriate data security measures.

Other recipients:
We may grant authorities or courts access to your data on a case-by-case basis in order to comply with legal obligations or to defend against legal claims.

Your data protection rights

The General Data Protection Regulation (GDPR) gives you certain rights when processing your personal data:

  1. Right to information under Article 15 of the General Data Protection Regulation
You have the right to request confirmation as to whether personal data relating to you is being processed; if so, you have the right to access that personal data and to the information referred to in Article 15 of the GDPR.
  2. Right of rectification and erasure in accordance with Articles 16 and 17 of the GDPR
You have the right to request, without undue delay, the rectification of inaccurate personal data concerning you and the completion of incomplete personal data.
In addition, you have the right to request that personal data concerning you be deleted without delay if one of the grounds set out in Article 17 of the GDPR applies.
  3. Right to restriction of processing in accordance with Article 18 of the GDPR
If one of the conditions set out in Article 18 GDPR is met, you have the right to request the restriction of processing.
  4. Right to data portability under Article 20 of the General Data Protection Regulation
You have the right to receive personal data relating to you in a structured, commonly used and machine-readable format in the cases set out in Article 20 of the GDPR. You also have the right to request the transfer of this data to a third party.
  5. Right to object under Article 21 of the GDPR
If the processing of data relating to you is based on Article 6(1)(f) of the GDPR, you have the right to object to processing on grounds relating to your particular situation at any time. We will then no longer process the personal data unless there are compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or the processing is for the establishment, exercise or defence of legal claims.
  6. Right to lodge a complaint with the supervisory authority
If you consider that the processing of your personal data is not lawful, you can lodge a complaint with the competent data protection authority in your country.

Your right to cancellation and deletion of your personal data

You can withdraw your consent at any time and exercise your “right to erasure/deletion”. In this case, we are obliged to delete the personal data relating to you. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal.
As a candidate, you can exercise your data protection rights centrally by emailing  datenschutz@beko.at.

How long will your personal data be stored?

Your data will generally be stored for 7 months after you have read this data protection information, after the recruitment process has been completed. If, in addition to the data protection information, you accept a separate voluntary declaration of consent to the processing and recording of your personal data after the recruitment process has been completed, your data will be stored for one year from the date of consent.
You will receive an email from us in good time before the expiry of these periods in which you will be able to (re)confirm your declaration of consent in order to be able to continue using your profile. If you give us your consent again, your candidate profile will remain with BEKO Solutions GmbH. Without your consent, your profile will be deleted.
As described above, you may withdraw your consent at any time and request the deletion of your personal data. Please note that in certain circumstances, deletion may not be carried out immediately, but only after a certain period of time due to legal obligations or in order to assert, exercise or defend legal claims.
We reserve the right to delete the profiles of candidates whom we have not been able to inform of suitable vacancies over a longer period of time. If a vacancy subsequently arises that you are interested in, you may re-apply at any time.
